SMS SPAM has been an increasing & ongoing problem in today’s mObile phone world. Forget the fact that people don’t like it, how about it’s against the law! How does that grab ya? Even large companies like Google & Nascar are getting nailed for SMS SPAM, which violates the Telephone Consumer Protection Act (TCPA) and the Controlling the Assault of Non-Solicited Pornography and Marketing (CAN-SPAM) Act. The rapper/producer Timberland also has been hit with a lawsuit albeit from the actions of a 3rd party marketer that he hired, but it still sucks. So, yeah, if you do this, you’re eventually toast because the carriers have cloud servers containing data of every message that goes out. All offenders will be taken down & hit with massive penalties. Apparently it can be $1500 per TEXT Message sent. OUCH!
Wanna avoid this? Just get your customers & clients to OPT-IN willingly. You can do this either by having them text a keyword to a short/long code, or have them sign a release that gives you the permission to message them under certain circumstances. For Doctors offices & any delivery services a simple release form would be adequate. If you need more assistance please don’t hesitate to contact a qualified attorney.
